Our client was riding his motorcycle and whilst filtering past a queue of traffic a tractor towing a large slurry container, turned right into his path. Our client tried to avoid a collision however, struck the front of the tractor and was thrown over it, landing heavily on the other side.

Our client sustained significant injuries including Cerebral contusion areas of micro haemorrhage, Occipital condyle fracture, Aspen collar worn for support. Large left haemothorax, right pneumothorax, several left and right rib fractures, L1 fracture and mild compression fractures of T2 and T3 for which he wore a TLSO brace for support. Abdominal injuries included bruising of liver and mesenteric bleed. Right clavicle fracture, right medial tibia plateau fracture with fibular head fracture, left distal radius fracture, right comminuted intra articular distal radius fracture and right ulnar styloid fracture.

Liability remains firmly in dispute by the Defendant and the case is currently ongoing. Currently we are reviewing extensive witness evidence which does not indicate the Claimants actions were unsafe. The key issue involves whether the tractor was indicating and if this was noticed by the Claimant.

Liability is therefore complex and will involve witness interviews and involvement of accident reconstruction experts.

The Claimant has had to change his lifestyle and is retraining in a hope of returning to work.

The case presents complexities on quantum with the onus of proof the injuries will continue to impact him in future years.

We have been able to start rehabilitation under the rehab code and as a firm we support claimants holistically to obtain the best early rehabilitation to help their chances of recovery.
