Cross border estates and dealing with foreign property when you die

Cross border estates and dealing with foreign property when you die

SJP Law are increasingly being called upon to help with family property and financial affairs after death that involve international cross border estates.

Many foreign courts, such as those in France, Germany and Poland, only accept documents with a court stamp. Therefore, it may be necessary to obtain a Grant of Probate in England and to arrange to have this notarised and marked with an apostille stamp to deal with property abroad after the death of the legal owner.

SJP Law can apply for a Grant of Probate on behalf of the executors and arrange for it to be notarised. This certification allows an English Will to be used to administer property abroad, if the English Will makes provision for the inclusion of foreign assets.

SJP Law may be able to help you draft a Will that covers your property and assets both in the UK and elsewhere and assist your executors to obtain a Grant of Probate after your death.
