The importance of having a Will and discussing it with your family and friends has been demonstrated by a recent high profile case of a disinherited daughter, who won back her family's £2.3million farm when the court declared her mother's Will was invalid.

A vital element of making a Will is to regularly review and revise its contents and openly discuss its provisions to avoid expensive disagreements in the future.  The judge gave the verdict after hearing that the daughter was given repeated assurances that she would inherit the family farm in North Yorkshire and had shown years of devoted support and care for her ageing parents.

The High Court ruled that her reclusive mother had been bullied into making the Will, leaving everything to the RSPCA.  The judge was satisfied that the deceased had "an avowed dislike" of the RSPCA and wanted her daughter to inherit the farm, but she had been unduly influenced by others.

Business and family assets change and a Will needs to reflect a person's future intentions and wishes.  When a Will's provisions are clear to all, its executors and the people directly affected by it, the benefit is a significant reduction in the strain on a family at a difficult time.
