Employment Law Update

Volcanoes and Emploment issues

Apologies in advance to those of you sick of hearing about unpronounceable Icelandic volcanoes.  However, the recent events have been causing disruption to many businesses as employees struggle to make their way home from trips abroad.

Employers are having to consider how to deal with any affected employees' pay and annual leave entitlement, given their extended absence from work.

There are a number of options available to employers and often no clear right or wrong answer.  The options include:

  • Treating additional absence as holiday and making deductions from the emplyee's annual holiday entitlement;

  • Treating additional absence as 'unpaid leave';

  • Agreeing with the employee that they will make up any lost time over coming weeks/months; or

  • Paying the employee full pay regardless and deducting no further holiday.

Employers should act in a consistent manner and follow any existing rules or policies they may have covering this, or any similar, situation.

How you should deal with this issue will depend upon a number of factors, including the specific circumstances and contract of employment.  If you are experiencing any problems and require help or guidance, please contact us on the details given below.
